How Paternity Is Actually Established in Tennessee
There are two paths to establishing legal paternity in Tennessee. Which path applies affects the timeline and what comes next.
Voluntary Acknowledgment of Paternity (VAP)
When both parents agree, they can sign a Voluntary Acknowledgment of Paternity, a legal document available at the hospital at birth or through the state afterward. A signed VAP establishes legal paternity without a court proceeding.
One important detail: a VAP can be rescinded within 60 days of signing. After that window, challenging it requires proving fraud, duress, or material mistake, a significantly higher bar.
Establishing paternity through a VAP does not automatically create a custody order or child support order. Those require a separate legal process.
Court-ordered paternity
When parentage is disputed, or when one party will not voluntarily acknowledge, the court can order genetic testing. DNA testing is conclusive in essentially all cases. Once testing confirms paternity, the court enters a legal order establishing fatherhood.
What comes after:
Legal paternity is the starting point. Once established, the parties address custody arrangements, parenting time, and child support, together or as separate proceedings depending on the situation and how much cooperation exists between the parties.
Establishing Paternity in Tennessee
Without established paternity, a father has no legal right to custody or parenting time regardless of his actual involvement in the child’s life. And a mother has no enforceable mechanism for child support.
